A Federal High Court in Abuja on Thursday declared the  proscription of the Peace Corps of Nigeria by the Nigeria Police as  null and void.

The Chief Judge of FHC Justice Ibrahim Auta, who delivered the judgment, said that  the police   had not given enough reason why the organisation should be proscribed and stressed that the Peace Corps  was not given fair hearing  before the proscription.
The court also stated that it was only a valid court order or judgment that could pronounce the proscription.
The CJ added that if the defendants felt that the organisation should be proscribed, they had to bring them to court and give reason why the court should do so.
The court further confirmed that the plaintiff was a registered organisation, recognised by the Nigeria Police itself, this was evident by virtue of the communication between the Peace Corps of Nigeria Police which was made available to the court.
The court also stated that it was on record that the Peace Corps had won several similar cases in  court challenging its existence as a legally registered entity.

The Nigeria Police Force, Minister of Justice and the National Security Adviser, who are defendants in the matter had stated in their preliminary  objection that the action file by the plaintiffs constituted an abuse of court process as another  similar case is pending at Abuja High Court.
